Booking Assistant Service Terms
Last updated: October 16, 2026
These Service Terms govern your subscription to the Datarrays Booking Assistant. "Datarrays", "we" and "us" means Datarrays of Charlotte, NC. "You" means the business that subscribes. By paying for a plan or accepting these Terms at checkout, you agree to them. Our general Terms of Service and Privacy Policy also apply. If they conflict with these Service Terms, these Service Terms control for the Booking Assistant.
1. The service
The Booking Assistant is an AI chat assistant for your business. It answers your customers' questions using information you approve and takes booking requests (appointments, service visits or consultations) through a booking form. Each booking request is sent to you by email, added as a "to confirm" event to the Google Calendar you share with us, logged as a new row in a booking log spreadsheet, and, if the customer provides an email address, acknowledged with a confirmation email to the customer.
| Plan | One-time setup | Includes |
|---|---|---|
| Starter | $199 | The assistant on your website or a hosted booking page |
| Plus | $229 | The assistant on your website, a hosted booking page, and a print-ready QR code |
| Everywhere | $250 | Everything in Plus, and we add your booking link to your Google Business Profile, Facebook page ("Book now" button) and Instagram bio |
Every plan is $99 per month (launch pricing) in addition to the one-time setup fee. All prices are in US dollars.
2. Setup
- After payment we send you a setup questionnaire. You provide accurate information about your business (services, service area, hours, prices you allow us to share, policies and common questions), an email address for booking alerts, and a Google Calendar shared with us.
- We write the assistant's answers from your information and build your booking form. We aim to have your assistant ready to test within 2–3 business days after we receive complete answers. This is a target, not a guarantee.
- You review and approve the assistant before it goes live. You are responsible for the accuracy of the information you give us and for telling us when it changes.
- Installation on your website requires access to your website settings, your web person's help, or a short call. Some website builders require a paid plan to add custom code. Those costs are yours.
- Everywhere plan: you give us manager or editor access to your Google Business Profile and Facebook page (or we walk you through the changes). We only make the agreed booking link changes, and you may remove our access afterwards.
3. Fees, billing and refunds
- The setup fee and the first month are charged at checkout. The monthly fee then renews automatically each month on the same date until you cancel. Payments are processed by Stripe.
- Setup fee: fully refundable if you cancel before we start building your assistant. Once setup work has begun, it is non-refundable.
- Monthly fee: billed in advance and not refunded for partial months.
- If a payment fails, we will notify you. If it isn't resolved within 7 days, we may pause your assistant until payment is made.
- We may change prices with at least 30 days' notice by email. New prices apply from your next billing date after the notice period.
- You are responsible for any taxes that apply to your purchase.
4. Cancellation
- Plans are month-to-month with no long-term contract. You can cancel at any time in the billing portal or by emailing us.
- Cancellation takes effect at the end of your current paid month. Your assistant keeps working until then.
- When service ends we turn off your assistant and booking page. Please remove the install code from your website. Your booking log spreadsheet is yours, and we will transfer it to your Google account on request.
- We may suspend or end the service for non-payment, misuse, or a breach of these Terms, with notice where reasonably possible. If we end the service for reasons other than your breach, we will refund any unused prepaid monthly fee.
5. Updates and support
Reasonable updates to your assistant's information, such as hours, services, prices, holiday closures and new questions and answers, are included in your monthly fee. We aim to make them within 1 business day of your request. Significant rebuilds, such as a new booking form for a different business or major redesigns, may be quoted separately. Support is by email at datarrays@gmail.com.
6. Booking requests are not confirmed appointments
The assistant collects booking requests at the customer's preferred day and time. It does not check your real availability or confirm appointments. You are responsible for reviewing each request, contacting the customer and confirming, rescheduling or declining it. Calendar events are marked "TO CONFIRM" for this reason.
7. AI limitations
- The assistant tells visitors that it is an AI assistant. It is instructed to answer only from the information you approve and not to invent prices, promises or guarantees, but AI can make mistakes, misunderstand a question or phrase something imperfectly.
- Tell us about any incorrect answer and we will correct it promptly. We are not responsible for statements based on inaccurate or outdated information you provided.
- The assistant is not a substitute for professional advice and must not be relied on for emergencies. It is instructed to direct urgent situations to your phone number or emergency services.
- We do not guarantee any number of bookings, leads, customers or revenue.
8. Your responsibilities
- Respond to booking requests in a timely manner and keep the information you give us accurate.
- Comply with the laws that apply to your business and your communications with customers, including privacy notices on your own website, the TCPA and Do Not Call rules when calling or texting customers, and industry rules such as fair housing laws.
- Do not use the assistant to collect health information, payment card numbers, government ID numbers or other sensitive information. It is not designed for HIPAA-regulated data.
- Do not use the service for unlawful, deceptive or harmful purposes.
9. Customer data and privacy
- Your customers' booking information belongs to you. We process it on your behalf only to provide the service: delivering it to you by email, calendar and spreadsheet, and keeping a backup record on our servers.
- To run the service we use trusted providers, including our AI model provider (to generate chat answers), our web host, our automation and email providers, Google (Calendar and Sheets) and Stripe (billing). We do not sell your customers' information or use it to market to them.
- We do not keep chat conversations after they are answered, except limited technical logs for security and rate limiting.
- We keep booking records while your subscription is active and delete our server copies within 90 days after it ends, except where we must keep them for legal reasons. Your spreadsheet and calendar copies stay under your control.
- If your business is outside the United States or subject to laws such as the GDPR, contact us before going live so we can discuss any additional terms you need.
10. Ownership
We own the Booking Assistant software, widget, booking page templates and related materials. You own your business information, logo, branding and customer data, and you give us permission to use them only to provide the service. With your permission, we may mention your business as a customer.
11. Availability and third parties
We work to keep the service running reliably, but we do not guarantee uninterrupted availability. The service depends on third-party providers (hosting, AI, email, Google, automation and payment services) whose outages are outside our control. Notifications may occasionally be delayed or not delivered, so please check your booking log regularly. We are not responsible for changes or downtime caused by your website platform.
12. Disclaimers and limitation of liability
Except as stated in these Terms, the service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, including lost bookings, lost profits or lost business, and our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the claim arose.
13. Indemnity
You agree to cover any claims, losses or costs arising from the information you provide to us, your use of the service in violation of these Terms or the law, and your dealings with your own customers.
14. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we will give active subscribers at least 30 days' notice by email. If you continue the service after a change takes effect, you accept the updated Terms. You may cancel before then.
